Compensation for Back Injuries From Previous Jobs

With a traumatic injury like a broken leg, the effects are immediate and obvious. An employer will often have to pay the injured worker compensation, and will have insurance covering them for this eventuality. Various types of injuries and illnesses may not be immediately apparent however, with symptoms only developing a long time after the event.

Hearing loss, for example, may not become apparent for a considerable period of time following exposure to excessive noise, while the lung condition asbestosis and the most fatal of all cancers mesothelioma, both caused by exposure to asbestos, may also take many years to develop. Similarly, a chronic back condition may worsen gradually over time, and may be left undiagnosed and untreated by doctors for an extended period.

It is often possible for a worker to claim compensation from a former employer for a back injury sustained at any point in the past. If a previous employer has ceased trading a claim can still be made, as long as a solicitor is able to identify and trace the company’s insurers for the relevant period. Former miners, for example, have been able to claim compensation for various illnesses contracted due to their working conditions years and sometimes decades after their employment ended. The standard limit of three years for bringing a personal injury claim may be taken from what is known as the date of knowledge; when a person became aware that their injury or condition was linked to their previous employment.
The majority of back problems are not caused by a specific accident, but are the result of cumulative strain placed on the back and spine. A condition may develop over a period of weeks, months or years, and often a person will continue working while being unaware of the problem. Even if a condition has been diagnosed a long time ago it will still be possible to make a claim, as long as a medical report shows that the problem was made significantly worse by a person’s working conditions. Employers are legally responsible for the safety of their employees, and must take reasonable care to help ensure they do not injure their backs at work.
