Compensation for Pedestrian Injured in Hit and Run Accident

A recent client was injured after he was hit by a driver while walking up a side road. Mr N later stated that the driver appeared to be texting and not paying attention to the road when the accident took place. The pedestrian was knocked onto the road verge, sustaining a fractured wrist and cut and bruising to his upper body. Instead of stopping at the scene, the driver accelerated away, meaning that neither Mr N nor any other witnesses to the accident were able to note down the vehicle’s registration number.

After requesting an incident report from the police, our solicitors were able to examine dashcam footage from a delivery van that had been on the same road at the time of the accident, and this ultimately allowed us to identify the vehicle's registration number, owner and insurance company, which was sufficient to begin a hit-and-run accident compensation claim against them.

Under the Road Traffic Act 1988, drivers are legally required to stop in the event of an accident and provide their contact details, which in this instance the hit and run driver had failed to do. Witness statements backed up Mr N’s assertion that the accident was wholly the driver’s fault, and this was accepted by the insurers after a few months of correspondence. Mr N later received £4,250 in compensation for his injuries, while the driver faced a criminal investigation for fleeing the scene of the accident.
