Compensation for Slip and Fall Down Stairs at Work

Ms J was an agency worker, temping at the distribution offices of a well-known furniture retailer. On her third day of work she was asked to fetch some folders from a storeroom at the back of the premises. She left the storeroom via a different door into a poorly lit work area that she did not know, and slipped and fell down a small flight of stairs on entering. The stairs did not have any handrails or anti-slip safety treads, neither was Ms J aware of the positioning of the light switches, which should in any case have been switched on during working hours.

Ms J suffered a sprained ankle, partially torn knee ligaments and strained muscles in her wrist. She was taken to hospital, kept in overnight for observation, and discharged the following day on crutches with her leg in plaster.

Ms J contacted Bartletts Solicitors for legal advice regarding her situation. As she was an agency worker, she was not paid during the 8 weeks she was forced to take off work, and suffered financial hardship as a result. She instructed us to begin a claim for compensation against her temporary employer. We wrote to them, stating that they had a legal responsibility to provide a safe working premises for staff. The stairs on which Ms J fell were unsafe, with no handrails or anti-slip safety treads. Furthermore on the day in question the stairwell was unlit, and as Ms J had not been shown this work area before, it was reasonably foreseeable that she would fall and injure herself. On admission of liability, Ms J received £9,500 in compensation for her injuries and loss of earnings.
Claiming with us is easy. Get a free no obligation initial consultation about your case, your rights, and our no win no fee agreement. All information can be taken over the phone. Medical treatment is local to you. We aim to keep the claims process short by keeping claims out of court. If your claim does need to go to court it is unlikely that you will need to attend court, as cases settle before the final hearing.
We can advise you about job security and dismissal concerns, as well as matters related to sick pay. Dismissal without a valid reason and without due procedures being followed is against the law, and can result in a claim for unfair dismissal being brought against the employer. Employers are also legally obliged to pay Statutory Sick Pay (SSP) to injured employees, and may pay more than the minimum depending on the terms of an individual’s employment contract. Compensation will pay for private healthcare treatment. It will also cover:

  • Physiotherapy
  • Psychological therapy
  • Expenses (such as the cost of travel to hospital appointments)
  • Loss of income
  • Household adaptations

  • The amount of compensation you receive will depend on the severity of your injuries and the likelihood that you’ll make a full recovery. We’ll seek expert opinions on what care you’ll need to ensure that the compensation we claim will be sufficient.
