Compensation for Nurses Injured Lifting Patients

Ms A was working as a trainee nurse at a private medical centre, assisting other nurses and practitioners in various capacities, including lifting and moving patients using specialist mechanical equipment. One evening working on the night shift, Ms A was instructed along with another nurse to transfer an immobile overweight patient to another room.

After finding out that the mechanical lifting equipment in the room was not working, they summoned an orderly, and attempted to lift and move the patient by hand. Ms A suffered a serious back sprain while attempting to lift the patient off the bed, was in considerable pain, and sought immediate medical attention. She was off work for 3 weeks, and still feels twinges in her back when lifting many months later.

Ms A decided to seek free legal advice from Bartletts Solicitors, and later engaged us to handle a compensation claim against her employers. We wrote to them, stating that Ms A was a trainee at the time of her injury, yet had not received adequate training in safe lifting techniques. This was in contravention of the Manual Handling Operations Regulations 1992, which imposes an obligation on employers to provide staff with proper training in safe manual handling practices. At the time of the incident the mechanical lifting equipment was defective, and this had also been a principle cause of Ms A’s injury. The medical centre eventually admitted liability for the accident, and Ms A received £7,500 in compensation from their insurers.
We have won a variety of cases for nurses and carers, ranging from a claim on behalf of a community support worker who was injured while lifting an immobile patient, to a claim on behalf of a private sector nurse who developed chronic lower back pain due to the excessive physical demands placed on her at work. See our case studies section to find out more or visit our Won Cases section.
Claiming with us is easy. Get a free no obligation initial consultation about your case, your rights, and our no win no fee agreement. All information can be taken over the phone. Medical treatment is local to you. We aim to keep the claims process short by keeping claims out of court. If your claim does need to go to court it is unlikely that you will need to attend court, as cases settle before the final hearing.
We can advise you about job security and dismissal concerns, as well as matters related to sick pay. Dismissal without a valid reason and without due procedures being followed is against the law, and can result in a claim for unfair dismissal being brought against the employer. Employers are also legally obliged to pay Statutory Sick Pay (SSP) to injured employees, and may pay more than the minimum depending on the terms of an individual’s employment contract. Compensation will pay for private healthcare treatment. It will also cover:

  • Physiotherapy
  • Psychological therapy
  • Expenses (such as the cost of travel to hospital appointments)
  • Loss of income
  • Household adaptations

  • The amount of compensation you receive will depend on the severity of your injuries and the likelihood that you’ll make a full recovery. We’ll seek expert opinions on what care you’ll need to ensure that the compensation we claim will be sufficient.
