Compensation for Hernia From Stacking Crates at Work

Mr J was temporarily employed at a food distribution warehouse where he worked mainly on the night shift stacking product crates for dispatch the following morning. For 2 weeks the warehouse experienced ongoing staff shortages, and the remaining night shift workers, including Mr J, found that they were expected to carry out the same amount of work, but with a third less staff.

A few weeks later Mr J began to feel pain in his groin and saw that a lump was developing. He saw his GP who diagnosed an inguinal hernia, most likely caused by excessive lifting and physical activity in the workplace. Mr J underwent successful surgery to repair his hernia, but was forced to take 2 months off work, during which time he was unpaid due to the terms of his contract.

Mr J contacted Bartletts Solicitors as he was frustrated by his employer’s failure to admit that working conditions at the warehouse had been responsible for his hernia injury. At the very least he felt that they should have paid him during his enforced time off work. We agreed to represent Mr J on a no win no fee basis and wrote to his employer arguing that during the 2 week period where the warehouse (by its own admission) was short staffed, Mr J had been required to move dangerous amounts of weight over the course of his shifts, and had not been allowed to take sufficient breaks by the night shift supervisor. Evidence provided by co-workers supported this assessment, though liability was initially denied by the employer. After further correspondence however they admitted partial liability for Mr J’s hernia injury, and he later received £5,250 in compensation.
We have won a variety of cases for clients with hernias caused by work, ranging from a claim on behalf of a client who developed a hernia from lifting heavy crates of books, to a claim on behalf of a warehouse worker who developed an inguinal hernia due to repetitive heavy lifting. Claiming with us is easy. Get a free no obligation initial consultation about your case, your rights, and our no win no fee agreement. All information can be taken over the phone. Medical treatment is local to you. We aim to keep the claims process short by keeping claims out of court. If your claim does need to go to court it is unlikely that you will need to attend court, as cases settle before the final hearing.
We can advise you about job security and dismissal concerns, as well as matters related to sick pay. Dismissal without a valid reason and without due procedures being followed is against the law, and can result in a claim for unfair dismissal being brought against the employer. Employers are also legally obliged to pay Statutory Sick Pay (SSP) to injured employees, and may pay more than the minimum depending on the terms of an individual’s employment contract. Compensation will pay for private healthcare treatment. It will also cover:

  • Physiotherapy
  • Psychological therapy
  • Expenses (such as the cost of travel to hospital appointments)
  • Loss of income
  • Household adaptations

  • The amount of compensation you receive will depend on the severity of your injuries and the likelihood that you’ll make a full recovery. We’ll seek expert opinions on what care you’ll need to ensure that the compensation we claim will be sufficient.
