Injuries Abroad - Wish You Weren't There?

Accidents and illness can spoil holidays. Bartletts Solicitors are the holiday accident claim experts protecting your rights at home and abroad. If you have been injured in an accident abroad which you do not believe was your fault, you could well be entitled to make a holiday accident claim.

Many people are injured or become ill on holiday because the safety and food hygiene standards are very often not as high as those to which we are accustomed. Since the introduction of new legislation, it has become possible for many people to claim compensation through the English courts.

We are specialist personal injury solicitors and have many years experience of handling holiday accident claims. As fully qualified solicitors and members of the Association of Personal Injury Lawyers who have to undergo rigorous annual training, we can say with confidence that you can be assured of our competence! We have many years of experience in recovering millions of pounds in compensation for clients.

Some of the holiday accident claims we see most frequently include:

  • Road Accidents Abroad on Touring Packages
  • Slips, Trips and Falls in Hotels
  • Food Poisoning/Illnesses at Hotels

  • If you bought your holiday through a UK registered tour operator, you may well be entitled to compensation. Also, if you sustain a holiday injury on an activity that was organised by the operator and part of your package deal, then you can make a holiday claim against your tour operator in the UK.

    • Food Poisoning on Holidays Abroad
    • Let the Experts Oversee Your Overseas Claim
Developing food poisoning while on holiday abroad can cause nasty and prolonged illness, as well as ruining what is usually a long-awaited and costly experience.

Food poisoning abroad is most common when holidaymakers are staying at destinations where hygiene and food preparation and handling standards are poor. This is often the case with all-inclusive holidays during which buffet meals are served daily. Bacteria can grow rapidly on buffet food, especially in hot weather and when dishes are left out for too long and not regularly replenished.

The most common bacteria which cause food poisoning are E. coli, listeria and salmonella, with symptoms including vomiting, diarrhoea, stomach cramps and a high temperature. The highly contagious norovirus also regularly infects holidaymakers, particularly those in busy, crowded and space-limited holiday environments such as on cruise ships.

UK registered tour operators can be held legally responsible for food poisoning and its consequences if a holiday abroad was booked as a package deal (e.g. flights + hotel stay).

Under the Package Travel, Package Holidays and Package Tour Regulations 1992, UK tour operators are responsible for the behaviour of their overseas representatives. Therefore, if a holidaymaker develops food poisoning due to the negligence of a foreign hotel or cruise line operator, they will often be able to claim compensation from the UK tour operator.
Remember there are strict time limits in place to make injury claims. Therefore, it is imperative that you contact us as soon as possible on 0151 521 7333 or fill in the online enquiry form for free advice.

Fact: We negotiated a £5,000 out of court settlement for a client who sustained injuries slipping on napkins left on a hotel restaurant floor. Our client received the full £5,000 without deduction.
