A recent client of Bartletts Solicitors was involved in a motorbike accident in Liverpool city centre, and was subsequently able to claim compensation from the negligent driver responsible. Mr J was riding up the side of a busy road in normal fashion when a car overtook him and clipped his motorbike in the process, causing Mr J to fall heavily onto the pavement and resulting in extensive damage to his motorcycle.

An ambulance attended the scene of the incident and Mr J was taken to hospital, where X-rays showed that he had dislocated his right shoulder and damaged ligaments in his upper body. He later required surgery and experienced mobility issues for 3 months due to an ankle injury sustained in the accident. Following a successful claim against the driver involved, Mr J received £4,450 in compensation from the latter’s insurers.
Recent Department of Transport figures show Liverpool, Wirral and Sefton are the most common areas where motorbike accidents occur in Merseyside, and that the number of accidents that happen each year remains stubbornly high, as more and more motorcyclists take to the road and traffic congestion becomes heavier. When a motorbike accident is the result of the carelessness of another road user, it will be possible for an injured motorcyclist to claim compensation for injuries that are often severe and potentially life-altering.
Motorbikes are faster, smaller and less stable than vehicles with four wheels and offer less protection to the rider than any other vehicle on major roads in the event of an accident, all reasons for the disproportionate number of accidents involving motorcyclists on UK roads. Motorbike accidents commonly result from other road users failing to notice a motorcyclist until it is too late to avoid a collision, or a motorcyclist being forced to swerve to avoid a vehicle pulling out or changing lanes unexpectedly. This is often due to the speed at which a motorbike is travelling and/or hazardous road conditions, such as when heavy rain or fog reduces visibility, or roads are slippery due to freezing weather conditions.
Motorbike accidents may also be the result of poorly maintained roads and road surface hazards, such as potholes or flooding. Highway authorities are responsible for ensuring that roads are in a reasonably safe condition for vehicles and drivers, and can be held liable for accidents resulting from their failure to do so. Spillages on the roads (e.g. oil or gravel) are especially hazardous for motorcyclists, and despite that face that the culprit may be impossible to identify in such circumstances, compensation claims can still be made through the Motor Insurers’ Bureau (M.I.B), a government body set up to compensate the victims of uninsured or untraceable drivers.
