Compensation for Falls on Holiday

Mr W was leaving his room at a Spanish hotel one evening to join some friends for dinner. On reaching the stairwell, he saw that the main overhead light was not working, and was descending the stairs carefully, when he fell, twisting his ankle and dislocating a finger. Apart from the lack of lighting, the stairwell did not have any banisters, meaning Mr W had no means of supporting himself in the darkness.

Hotel staff called a local doctor, who treated Mr W at the scene. His holiday was effectively ruined, and he returned to the UK later the same week on crutches, and was unable to walk properly for 3 weeks.

Mr W contacted Bartletts Solicitors with the question: how can I sue a Spanish hotel for an accident? We advised him that because his holiday had been booked as a package deal with a UK tour operator, he could bring a personal injury compensation claim against the latter under UK law. We wrote to the tour operator stating that poor lighting and the lack of banisters in the stairwell had directly caused Mr W’s accident. The duty of care that the tour operator owed Mr W had therefore been breached, due to the negligence of their overseas representatives (the hotel’s management). Mr W received £3,750 for his injuries and the loss of enjoyment of his holiday.
