Case Study - Pedestrian Struck By Bus Wing Mirror
Mr T was walking along on the pavement on a London street, when he was struck on the back of the head by the wing mirror of a Transport for London bus that was driving up from behind him, and knocked to the ground. Other pedestrians came to his assistance and he was taken to hospital, where he required stitches for a cut to the head and was diagnosed with a bad concussion. He was kept in overnight for observation and discharged the following day, but continued to experience headaches for a week afterwards, and was forced to take 10 days off work. The bus had not stopped following the collision with Mr T, and following his complaint, Transport for London refused to accept responsibility for the incident. Based on their lack of response, and the injury and loss of earnings that the accident had caused, Mr T decided to seek legal advice.
Our Legal Advice
Having read about our experience of claiming compensation for those injured by negligent bus driving, Mr T contacted Bartletts Solicitors to ask; can I claim compensation for being hit by a bus wing mirror? After reviewing the the facts surrounding the accident, we advised Mr T that he had strong grounds for making a claim, and agreed to represent him in a no win no fee claim against Transport for London. During correspondence with the latter, we maintained that Mr T’s injuries had been caused by inattention or carelessness on the part of the bus driver, while Transport for London claimed it was not the driver’s fault, and that Mr T had been standing too close to the kerb when he was struck by the bus’s wing mirror. We were able to produce witness statements supporting our client’s version of events, however, and this was enough to reach a settlement with the government body. Mr T later received £3,250 in compensation for being injured by the bus wing mirror.
