Motorcyclist Injured After Swerving to Avoid Collision

A recent client, Mr T, was injured while riding his motorcycle when he swerved to avoid a van that was turning right off a single carriageway road. The van driver had seen that a car was approaching up the road, but judged that he had just enough time to perform the manoeuvre. However, he had failed to notice Mr T, who was filtering past the slow-moving car at a considerable higher speed (though still within the speed limit for the road) at the time the van driver was executing the turn. Mr T swerved to avoid colliding with the van but lost control of his motorcycle and the vehicle came down, skidding along the tarmac, with Mr T’s leg trapped underneath it.

The drivers of the two vehicles stopped to come to the motorcyclist’s aid, and he was later taken to hospital where he was treated for a comminuted fracture of the tibia bone in his leg. Mr T ultimately made a full recovery from his injury, and decided to seek legal advice after being dissatisfied with a compensation offer made by the van driver’s insurers.

Having read about our firm’s experience in handling motorcycle accident claims, Mr T instructed Bartletts Solicitors to represent him in a compensation claim against the motorist. In correspondence with the latter party’s insurers, we argued that the van driver had failed in his duty to check that the road was safe before commencing his turn, and that this amounted to negligence. The driver should have been able to see the motorcycle overtaking the car, as Mr T was wearing a high visibility vest and was around 40 metres from the van at the time the driver commenced the turn. Mr T had not been breaking the speed limit at the time, and so was entirely blameless for being forced to swerve, and for losing control of his motorcycle. 100% liability for the accident therefore rested with the van driver, and the motor insurance company eventually accepted this, with Mr T receiving £4,750 in compensation.
